Player Terms of Service
この文書は英語で表示しています。英語版が正式な文書です。
Player Terms of Service
In plain language (this box is a summary only and is not legally binding). Benerits is a free browser-game portal. The games are made by independent studios we call Publishers; we review every version before it goes live, but the games are theirs, not ours. You can play as a guest or create an account. You must be at least 13 (or older where your country's law requires), and if you are a minor, a parent or guardian must agree to these Terms for you. Ads are what keep the service free; rewarded ads are always your choice. Play fair: no cheating, bots, exploits or ad fraud. Cloud saves are a convenience, not a guarantee. If we restrict your account, we tell you why and you can appeal within 30 days. You can delete your account at any time in your settings. If you are a consumer, the mandatory consumer protections of your country always apply and nothing in these Terms takes them away.
1. Who we are and what these Terms cover
1.1 These Player Terms of Service (the "Terms") form a binding agreement between you and [BENERITS LEGAL ENTITY NAME], a company incorporated in the Republic of Türkiye with its registered address at [REGISTERED ADDRESS], registered with trade registry / MERSIS number [TRADE REGISTRY / MERSIS NO.], tax office and tax number [TAX OFFICE / TAX NO.] ("Benerits", "we", "us" or "our"). You can contact us at [CONTACT EMAIL: [email protected]]. Where we have appointed one, our representative in the European Union is [EU REPRESENTATIVE, if appointed].
1.2 These Terms govern your access to and use of the Benerits game portal, including its websites, the game player, the software development kit that games use to talk to the portal, any native application wrapper we make available, and all related features and services (together, the "Service").
1.3 These Terms incorporate by reference the following documents, each as amended from time to time: the Content Policy & Community Guidelines (the "Content Policy"), the Copyright & Takedown Policy (the "Copyright Policy") and the Cookie Policy. Our Privacy Policy explains how we process your personal data; it is provided for your information and is not a contractual document, except to the extent applicable law requires otherwise.
1.4 If you are also a Publisher or a participant in our creator programme, your activities in those capacities are governed by the Publisher Distribution Agreement or the Creator Programme Terms (as applicable). These Terms continue to apply to your use of the Service as a player.
1.5 Acceptance. You accept these Terms by ticking the acceptance box when you create an Account or, if you play as a Guest, by using the Service after being shown a notice linking to these Terms. We keep a record of your acceptance (including the version of the Terms accepted, the date and time, and technical data such as IP address and browser user agent) as described in the Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Definitions
2.1 In these Terms, the following capitalised terms have the meanings set out below:
- "Account" means a registered player account on the Service, identified by an email address and a username.
- "Anonymous ID" means the random identifier stored in the
lonca_anoncookie that we assign to a browser so the Service can remember a Guest's activity without an Account, as described in the Cookie Policy. - "Cloud Save" means game progress data that an approved Game stores on our servers through the SDK and associates with your Account or Anonymous ID.
- "Consumer" means a natural person acting for purposes that are wholly or mainly outside their trade, business, craft or profession, including a "tüketici" within the meaning of Turkish Law No. 6502 on Consumer Protection.
- "Game" means any game, demo or interactive content made available on or through the Service, including each of its versions.
- "Guest" means a person who uses the Service without signing in to an Account.
- "In-Game Reward" means any virtual item, currency, life, hint, bonus or other in-game benefit granted by a Game, including in exchange for watching a Rewarded Ad.
- "Leaderboard" means any ranking, high-score table or similar public list of Player performance displayed on the Service.
- "Mandatory Consumer Law" means the provisions of the law of your country of habitual residence that cannot be excluded or limited by contract, including, where applicable, Turkish Law No. 6502 on Consumer Protection and its secondary legislation, Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, Directive 93/13/EEC on unfair terms in consumer contracts and Directive 2011/83/EU on consumer rights, each as implemented in national law, and the UK Consumer Rights Act 2015.
- "Player", "you" or "your" means any person who accesses or uses the Service to play Games or use player features, whether as a Guest or through an Account.
- "Publisher" means an independent developer, studio or other person that makes a Game available on the Service under a Publisher Distribution Agreement with Benerits.
- "Rewarded Ad" means an advertisement that you choose to watch in exchange for an In-Game Reward.
- "SDK" means the Benerits software development kit through which Games communicate with the Service (for example, to request advertisements, submit scores or store Cloud Saves).
- "User Content" means any content you submit to the Service, including your username, display name, profile bio, profile website link, avatar (where available), votes, and any reports, appeals or messages you send us.
2.2 Headings are for convenience only. The words "including" and "for example" are illustrative and do not limit the preceding words.
3. Eligibility and age
3.1 Minimum age. You must be at least 13 years old to use the Service. If the law of your country of residence sets a higher minimum age for consenting to the processing of personal data in connection with online services (the "digital age of consent", for example 14, 15 or 16 in certain EU Member States), you may create an Account only if you have reached that age or a parent or legal guardian has given or authorised consent in the manner we request.
3.2 Minors. If you are under the age of legal majority in your country of residence (18 in Türkiye and in most EU Member States), you confirm that your parent or legal guardian has read and agreed to these Terms on your behalf and consents to your use of the Service. Parents and legal guardians who allow a minor to use the Service are responsible for supervising that use and accept these Terms on the minor's behalf.
3.3 Children under 13. The Service is not directed to children under 13 and we do not knowingly collect personal data from children under 13. If we learn that a child under 13 (or under the applicable digital age of consent, without the required parental consent) has created an Account, we will close the Account and delete the associated personal data as described in the Privacy Policy. A parent or guardian who believes this has happened should contact us at [DPO / KVKK CONTACT: [email protected]].
3.4 Advertising and minors. We do not serve personalised advertising to Players we know or have reason to believe are under 16, or where the required consent has not been given. See clause 9 and the Privacy Policy.
3.5 Other restrictions. You may not use the Service if we have previously terminated your Account for a breach of these Terms (unless we have expressly allowed you to return), or if you are prohibited from receiving the Service under the laws applicable to you, including applicable sanctions laws.
3.6 Age-sensitive Games. Some Games carry content descriptors or age labels under the Content Policy. You agree not to play Games labelled as unsuitable for your age, and parents and guardians are responsible for deciding which Games are appropriate for the minors they supervise.
4. Accounts and security
4.1 Creating an Account. You can use many features as a Guest, but some features (such as Leaderboards, a public profile, likes and favourites synchronised across devices, and Cloud Saves that follow you across devices) require an Account. To create an Account you must provide a valid email address, choose a username and set a password. You must give accurate information and keep your email address up to date.
4.2 One person, one Account. Accounts are personal. You may not share your Account, let others use it, sell, transfer or lend it, or create Accounts on someone else's behalf (other than a parent or guardian acting for a minor under clause 3.2). You may not create multiple Accounts to evade a restriction, manipulate Leaderboards or votes, or otherwise breach these Terms.
4.3 Security. You are responsible for keeping your password confidential and for all activity under your Account that results from your failure to do so. Use a strong password that you do not use elsewhere. Tell us immediately at [CONTACT EMAIL: [email protected]] if you suspect unauthorised use of your Account. We store passwords only as salted cryptographic hashes and will never ask for your password by email.
4.4 Verification and recovery. We may ask you to verify your email address or your identity to protect your Account, for example when you reset your password or sign in from a new device. We may refuse to restore access where we cannot verify that you are the Account holder.
4.5 Usernames. We may reclaim or require you to change a username that breaches the Content Policy, infringes a third party's rights, impersonates another person, or has been inactive in accordance with clause 15.5.
5. Guest play
5.1 You may play most Games without an Account. When you do, we assign your browser an Anonymous ID so the Service can remember your recently played Games, your Cloud Saves for Games that support them, and similar preferences, and so we can detect abuse and count plays. The Anonymous ID is described in the Cookie Policy and the Privacy Policy.
5.2 Guest data is tied to a single browser. If you clear your cookies, use private browsing, switch browser or device, or the Anonymous ID expires, the Service will not be able to recognise you and your Guest data (including Guest Cloud Saves) may become permanently inaccessible. We have no means of recovering Guest data for you.
5.3 If you create an Account or sign in on a browser that holds an Anonymous ID, we will link that browser's Guest data (including Guest Cloud Saves, recent plays, likes and favourites) to your Account so you do not lose your progress. Where your Account already holds data for the same Game, the Service may keep the Account's data and discard the Guest copy, or ask you which one to keep.
5.4 These Terms apply to Guests in the same way as to Account holders, except for the provisions that by their nature concern an Account.
6. Licence to use the Service and play Games
6.1 Licence. Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service, and to access, display and play the Games made available on it, solely for your own personal and non-commercial entertainment. To the extent any Game is owned by a Publisher, we grant this licence on the Publisher's behalf under the rights the Publisher has granted to us.
6.2 Restrictions. Except as expressly permitted by these Terms or by mandatory law, you may not: (a) copy, download (other than the temporary caching your browser performs automatically), mirror, frame, re-host, sell, rent, distribute or publicly perform any Game or any part of the Service; (b) decompile, disassemble, reverse engineer or attempt to derive the source code of any Game, the SDK or the Service, except to the extent such restriction is prohibited by applicable law (including Article 6 of Directive 2009/24/EC and Article 38 of Turkish Law No. 5846 on Intellectual and Artistic Works) and then only for the purposes permitted by that law; (c) remove, obscure or alter any copyright notice, trademark, label or advertisement; (d) embed Games or the Service on another website or application, or use them for any commercial purpose, without our prior written consent; (e) use any robot, scraper, crawler or other automated means to access the Service or collect data from it, other than generally available search engine crawlers acting in accordance with our robots.txt file; or (f) use the Service in breach of the Content Policy or any applicable law.
6.3 Gameplay videos and streaming. You may record, stream and share videos and screenshots of your own gameplay, including on monetised channels, provided that you: (a) do not present the footage as your own game or suggest that you or your channel are endorsed by Benerits or the Publisher without permission; (b) do not distribute the Game itself or any part of its code or assets outside the footage; (c) comply with any content-capture rules the Publisher displays in the Game; and (d) comply with the Content Policy and all applicable advertising disclosure rules. Participation in our paid creator programme is governed separately by the Creator Programme Terms. We or the Publisher may ask you to remove footage that breaches this clause.
6.4 No transfer of ownership. The Service and the Games are licensed, not sold. No rights are granted to you other than those expressly set out in these Terms.
7. Third-party Games and Publishers
7.1 Games are made by independent Publishers. Games on the Service are created, owned and controlled by independent Publishers, not by Benerits (unless a Game is expressly identified as a Benerits original). Publishers are not our employees, agents or partners. Each Publisher is responsible for its Games, including their content, operation, functionality and compliance with law.
7.2 Our review. We review every version of every Game before it is released on the Service, using a combination of human review and automated checks, to assess compliance with our technical requirements and the Content Policy. Our review is designed to protect the Service and its Players; it is not a guarantee. To the fullest extent permitted by law and subject to clause 18, we do not warrant that any Game is free from errors, bugs, inaccuracies, objectionable content or security vulnerabilities, that it will meet your expectations, or that it will remain available.
7.3 Sandboxing. Games run in an isolated environment on a separate domain that cannot read the portal's cookies or your Account credentials. Games may store data locally in your browser on that domain, as described in the Cookie Policy.
7.4 Externally hosted Games. Some Games are loaded from servers operated by the Publisher or its hosting provider rather than by us. When you play such a Game, your browser connects to those servers and they receive the technical data your browser sends (such as your IP address and user agent). Publishers are contractually prohibited from placing their own advertising, trackers or third-party analytics in Games and from collecting personal data except where strictly necessary to deliver the Game.
7.5 Publisher notices. A Game may display additional notices or rules from its Publisher (for example, credits, gameplay rules or content-capture rules). Those rules apply to your play of that Game to the extent they are consistent with these Terms and the Content Policy. If there is a conflict, these Terms prevail as between you and Benerits.
7.6 Availability of Games. Games may be updated, changed, restricted to certain territories or devices, moved between launch stages, or withdrawn at any time, by us or by the Publisher, including for reasons outside our control. A Game's withdrawal may affect associated Cloud Saves, scores and Leaderboards as described in clauses 10 and 11.
7.7 Reporting Games. If you believe a Game is illegal, breaches the Content Policy or infringes rights, please report it using the "Report" function on the Game page or by the means set out in the Content Policy or the Copyright Policy.
8. Acceptable use and fair play
8.1 General conduct. You agree to use the Service lawfully, in good faith and in accordance with these Terms and the Content Policy. You must not: (a) harass, threaten, bully, defame, discriminate against or impersonate any person; (b) post or transmit illegal content or content prohibited by the Content Policy; (c) collect or disclose other people's personal data; (d) upload or transmit viruses, malware or other harmful code; (e) probe, scan or test the vulnerability of the Service or breach any security or authentication measure, except through a responsible disclosure process we have published or approved; (f) interfere with, overload or disrupt the Service, its servers or networks (including by denial-of-service attacks); (g) circumvent any geographic, age or technical restriction; or (h) use the Service to send spam or unsolicited communications.
8.2 Cheating and exploits. Leaderboards and scores must reflect genuine human play. You must not: (a) use cheats, hacks, trainers, memory editors, speed hacks, macros, auto-clickers, bots or other software or hardware that modifies a Game or automates or gives an unfair advantage in gameplay; (b) intercept, alter, forge, replay or inject requests between a Game, the SDK and our servers, including to submit scores you did not achieve or to alter Cloud Saves; (c) exploit bugs, glitches or design errors to obtain scores, In-Game Rewards or other advantages (you should report them to us or the Publisher instead); (d) coordinate with others, or use multiple Accounts, to manipulate Leaderboards, votes, likes, favourites, play counts or rankings; or (e) sell, buy, trade or transfer Accounts, scores or Leaderboard positions.
8.3 Advertising fraud. Advertising funds the Service and the Publishers. You must not generate or attempt to generate invalid advertising traffic, including by: (a) clicking or causing clicks on advertisements other than out of genuine interest; (b) using bots, scripts, emulators, click farms, proxies or automated tools to generate ad impressions, clicks or plays; (c) offering or accepting incentives for viewing or clicking advertisements outside the Rewarded Ad features built into the Service; (d) tampering with, spoofing or manipulating the SDK, ad requests, ad tags or reporting; or (e) repeatedly reloading Games or pages to generate impressions. You may use browser settings or tools that block advertisements, but some features that depend on advertising (such as Rewarded Ads) may then be unavailable.
8.4 Detection. We use automated systems and human review to detect cheating, invalid traffic and abuse. Automated flags may lead to temporary protective measures (for example, withholding a score from a Leaderboard pending review). Decisions that significantly affect you, such as suspending or banning an Account, involve human review as described in clause 13 and the Privacy Policy.
8.5 Consequences. If we reasonably determine that you have breached this clause 8, we may, in addition to the measures in clause 13, remove or reset affected scores and Leaderboard entries, remove votes or other activity, reset or remove Cloud Saves or In-Game Rewards obtained through the breach, and report the matter to the relevant Publisher, advertising partner or, where required or appropriate, to the competent authorities.
9. Advertising
9.1 How the Service is funded. The Service is free to use. In return, you agree that the Service and Games display advertising, including interstitial (full-screen, shown at natural breaks such as between levels), banner and Rewarded Ads. All advertising on the Service is served by Benerits through its advertising management system and its advertising partners, currently AppLovin (including its MAX mediation platform) and Google (including AdMob, Google Ad Manager and H5 Games Ads); we may add or change advertising partners. Publishers are not permitted to include their own advertising in Games.
9.2 Rewarded Ads are optional. Rewarded Ads are shown only when you actively choose to watch one in exchange for an In-Game Reward. The Game decides and grants the In-Game Reward. If an advertisement fails to load, is closed early or cannot be verified as watched, the In-Game Reward may not be granted, and neither we nor the Publisher are obliged to grant it. We do not guarantee that a Rewarded Ad will always be available.
9.3 Personalised and non-personalised ads. Where the law requires your consent to personalised advertising or to the storage of or access to information on your device for advertising purposes, we ask for it through our consent management tool (which, in the EEA and UK, implements the IAB Europe Transparency & Consent Framework). If you do not consent, or if we know or have reason to believe you are under 16, we request only non-personalised or contextual advertising (which may still use limited data for purposes such as frequency capping, fraud prevention and measurement, as described in the Privacy Policy). You can change your choices at any time through the "Privacy choices" link in the footer.
9.4 Advertiser content. Advertisements are the responsibility of the respective advertisers. We apply category blocks and ad-quality controls through our advertising partners, and we do not knowingly allow advertising that breaches applicable law or is inappropriate for a general audience, but we do not control or endorse advertised products or services. If you see an inappropriate advertisement, please report it to us.
9.5 In-Game Rewards have no real-world value. In-Game Rewards are a limited licence to use a feature within a Game. They have no monetary value, cannot be exchanged for money or anything of value, cannot be transferred between Games or Players, and may be modified or lost if a Game is updated or withdrawn, subject to Mandatory Consumer Law. The Service does not currently offer any paid purchases.
10. Cloud Saves
10.1 What they are. For Games we have approved for the Cloud Save feature, the Game may store your progress on our servers through the SDK, linked to your Account or, if you are a Guest, to your Anonymous ID. The content of a Cloud Save is determined by the Game, not by us.
10.2 Availability. Cloud Saves are provided as a convenience. We take reasonable technical and organisational measures to store them reliably, but, subject to clause 18, we do not guarantee that Cloud Saves will always be available, that they will be stored permanently, that they will be compatible with future versions of a Game, or that they will be free from loss or corruption. We may apply reasonable storage limits per Game and per Player.
10.3 When Cloud Saves may be lost or deleted. Cloud Saves may be deleted or become inaccessible: (a) when you delete your Account (Cloud Saves are deleted together with your Account); (b) for Guests, when the Anonymous ID is lost or expires under clause 5.2; (c) when a Game is withdrawn from the Service, after the retention period set out in the Privacy Policy; (d) when a Publisher releases a version of a Game that changes or resets its save format; (e) when a Cloud Save has been obtained or altered through a breach of clause 8; or (f) when Cloud Save support is withdrawn from a Game. Where reasonably practicable, we will give advance notice on the Service before Cloud Save support for a Game is withdrawn.
10.4 No manipulation. You must not alter, forge, copy or transfer Cloud Saves except through the Game's normal operation.
11. User Content
11.1 Your responsibility. You are responsible for your User Content. Your username, display name, profile bio, profile website link and any other public profile information, as well as your scores on Leaderboards, are visible to other users of the Service and may be visible to the public and to search engines. Do not include personal data in public User Content that you do not want to make public.
11.2 Rules. User Content must comply with the Content Policy, including its rules on usernames. In particular, User Content must not be illegal, infringing, hateful, harassing, sexual, misleading, contain personal data of others, contain links to malicious or prohibited content, or impersonate any person or Benerits.
11.3 Licence to us. You retain any rights you have in your User Content. You grant Benerits a worldwide, non-exclusive, royalty-free, sublicensable (only to our service providers acting on our behalf) licence to host, store, reproduce, display, adapt (for formatting and technical purposes only), and communicate to the public your User Content, solely for the purposes of operating, providing, securing and improving the Service. This licence ends when your User Content is deleted from the Service, except for: (a) copies retained in backups for the limited periods set out in the Privacy Policy; (b) copies we must keep to comply with law or to establish, exercise or defend legal claims; and (c) User Content that has been incorporated into public activity in a way that cannot reasonably be separated (for example, historical Leaderboard snapshots), which we will anonymise where practicable.
11.4 Moral rights. To the extent permitted by applicable law, you agree not to assert moral rights in your User Content against Benerits or its service providers in a way that would prevent the uses described in clause 11.3. Nothing in this clause waives moral rights that cannot be waived under applicable law.
11.5 Your warranty. You represent that you have all rights necessary to submit your User Content and to grant the licence in clause 11.3, and that your User Content does not infringe any third party's rights or breach any law.
12. Moderation
12.1 Our approach. We moderate User Content, Games and Player conduct to enforce these Terms and the Content Policy and to comply with the law. Moderation combines automated tools (for example, filters that flag usernames and bios for review, and systems that detect anomalous scores or advertising traffic) with human review. We are not obliged to monitor User Content in general, but we act on notices and on issues we become aware of.
12.2 Measures we may take. Depending on the severity, context and history of a breach, we may take one or more of the following measures: (a) remove, hide or restrict the visibility of User Content (including resetting a username or bio); (b) remove or reset scores or Leaderboard entries; (c) issue a warning; (d) restrict particular features (for example, hide your profile from Leaderboards); (e) temporarily suspend your Account or your access to the Service; (f) permanently terminate your Account ("ban"); and (g) report the matter to competent authorities where required or appropriate. Our choice of measure will be proportionate, taking into account the Content Policy's enforcement guidelines.
12.3 Notices from others. Anyone may notify us of content or conduct they consider illegal or in breach of our rules. We process notices in a timely, diligent, non-arbitrary and objective manner, and we inform the notifier of our decision where we have their contact details. The Content Policy explains how to submit a notice, including notices under Regulation (EU) 2022/2065 (the Digital Services Act) and Turkish Law No. 5651. Copyright notices are handled under the Copyright Policy.
13. Suspension, bans and appeals
13.1 Statement of reasons. If we restrict your User Content or your Account, we will inform you by email (or, if you are a Guest or we have no valid email address, through the Service where possible) no later than the time the restriction takes effect, with a clear and specific statement of reasons that includes: (a) the measure taken and its scope and duration; (b) the facts and circumstances relied on; (c) whether the decision was made or detected using automated means; (d) the legal ground or the provision of these Terms or the Content Policy relied on; and (e) how to appeal and any other redress available to you.
13.2 Exceptions to notice. We may delay or limit the information in clause 13.1 where giving it would be prohibited by law or by an order of a competent authority, would compromise an ongoing investigation into fraud, cheating, invalid traffic or a criminal offence, would enable circumvention of our detection systems, or would put a person's safety at risk, or where the content is deceptive high-volume commercial content. In those cases we will provide as much information as we lawfully and safely can, as soon as the reason for the delay no longer applies.
13.3 Immediate measures. We may suspend an Account immediately and without prior notice where we reasonably believe that: (a) the Account has been compromised; (b) the Account is involved in serious or repeated breaches of clause 8 or the Content Policy; (c) there is a risk to the safety of any person or to the security or integrity of the Service; or (d) the suspension is required by law or by a competent authority.
13.4 Appeals. If you disagree with a moderation decision, you may appeal by email to [CONTACT EMAIL: [email protected]] with the subject line "Appeal", within 30 days of the date you were notified of the decision. Where Regulation (EU) 2022/2065 or other applicable law gives you a longer period in which to lodge a complaint (currently six months under Article 20 of that Regulation, where it applies to us), that longer period applies. Your appeal should identify your Account (username and email address), the decision you are appealing and why you believe it is wrong, together with any supporting information.
13.5 Handling of appeals. Appeals are reviewed by a member of our team who was not involved in the original decision, under the supervision of appropriately qualified staff, and are not decided solely by automated means. We aim to decide appeals within 14 days and will tell you the outcome and reasons. If we find that the decision was wrong, we will reverse it without undue delay, restoring your Account, User Content or scores as far as technically possible.
13.6 Other redress. Our appeal process does not affect your right to bring the matter before a competent court or authority. If you are in the EU and Article 21 of Regulation (EU) 2022/2065 applies, you may also refer the dispute to a certified out-of-court dispute settlement body. If you are in Türkiye, you may also apply to the competent criminal judgeship of peace (sulh ceza hâkimliği) or authority under Turkish Law No. 5651 where applicable.
13.7 Misuse of reporting and appeals. We may, after a prior warning, suspend for a reasonable period the processing of notices and appeals from any person who frequently submits manifestly unfounded notices or complaints, as described in the Content Policy.
13.8 Circumvention. You may not create a new Account or otherwise use the Service to circumvent a suspension or ban.
14. Your right to terminate and account deletion
14.1 Stopping use. You may stop using the Service at any time.
14.2 Deleting your Account. You may delete your Account at any time through your account settings, or by emailing [DPO / KVKK CONTACT: [email protected]] from the email address associated with the Account. On deletion: (a) your Account is closed immediately and you can no longer sign in; (b) your profile, username, scores, Leaderboard entries, likes, favourites and Cloud Saves are removed from public view without undue delay and deleted, together with other personal data associated with your Account, in accordance with the retention periods in the Privacy Policy; and (c) we may keep limited data where we are legally required to or where necessary to establish, exercise or defend legal claims, to prevent fraud or to enforce a ban, as set out in the Privacy Policy.
14.3 Deletion is final. Account deletion cannot be undone once the deletion process has completed. We cannot recover deleted Cloud Saves, scores or other data. Your username may become available to other users after a reasonable period.
15. Termination and suspension by us
15.1 For breach. We may suspend or terminate your Account or your access to the Service, in whole or in part, if you materially or repeatedly breach these Terms or the Content Policy, in accordance with the process in clauses 12 and 13.
15.2 For other valid reasons. We may also terminate your Account or discontinue the Service or any part of it: (a) where required by law or by an order of a competent authority; (b) where continuing to provide the Service to you would expose us to legal liability or regulatory sanction; or (c) where we decide to discontinue the Service in its entirety or in your country.
15.3 Notice. Except where clause 13.2 or 13.3 applies, we will give you at least 30 days' notice by email (where available) before terminating your Account under clause 15.2 or discontinuing the Service, so that you have the opportunity to take any steps available to you.
15.4 Effect of termination. On termination, your licence under clause 6 ends. Clauses 11.3 (to the extent stated), 16, 17, 18, 19, 20, 22 and 23, and any other provisions that by their nature should survive, survive termination.
15.5 Inactive Accounts. If you do not sign in to your Account for 36 consecutive months, we may treat the Account as inactive and delete it, after giving you at least 30 days' notice to the email address associated with the Account. Signing in during the notice period keeps the Account active.
16. Intellectual property
16.1 Benerits' rights. The Service, including its software, SDK, design, text, graphics, logos, trade names and trademarks, and the selection and arrangement of its content (but excluding Games and User Content), is owned by or licensed to Benerits and protected by intellectual property laws, including Turkish Law No. 5846 on Intellectual and Artistic Works and Turkish Industrial Property Law No. 6769.
16.2 Publishers' rights. Each Game, and the names, characters, artwork, music, code and other elements in it, is owned by its Publisher or the Publisher's licensors.
16.3 Trademarks. You may not use "Benerits" or any other name, logo or trademark of Benerits or of any Publisher without prior written permission, except to identify the Service or a Game truthfully and in a way that does not suggest endorsement.
16.4 Respecting others' rights. We respect intellectual property rights and expect you to do the same. Infringement notices, counter-notices and our repeat infringer policy are set out in the Copyright Policy.
17. Feedback
17.1 If you send us ideas, suggestions or other feedback about the Service or Games ("Feedback"), you grant Benerits a perpetual, irrevocable, worldwide, royalty-free and non-exclusive right to use, reproduce, modify and exploit the Feedback for any purpose without compensation or attribution to you, to the extent permitted by applicable law. We may share Feedback about a Game with its Publisher. You should not send us Feedback that you consider confidential or that contains third-party rights.
18. Disclaimers
18.1 Mandatory rights preserved. Nothing in this clause 18 excludes or limits any warranty, guarantee, conformity obligation or remedy that cannot be excluded or limited under applicable law, including your rights as a Consumer under Mandatory Consumer Law (such as, in the EU, the trader's liability for lack of conformity of a digital service supplied in exchange for personal data under Directive (EU) 2019/770 as implemented in national law).
18.2 Service provided "as is". Subject to clause 18.1, the Service and Games are provided free of charge on an "as is" and "as available" basis. To the fullest extent permitted by law, Benerits makes no warranties or representations, express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement, and does not warrant that the Service or any Game will be uninterrupted, timely, secure, error-free or free from viruses or other harmful components, that defects will be corrected, or that Cloud Saves, scores or other data will be preserved.
18.3 Third parties. Subject to clause 18.1, we are not responsible for Games (which are the responsibility of their Publishers under clause 7), for advertisements and advertised products or services, for third-party websites linked from the Service, or for the conduct of other users.
18.4 Technical requirements. The Service requires a compatible device, a supported web browser and an internet connection, which you are responsible for providing. Some Games may not work on all devices or browsers. You are responsible for any data charges from your network operator.
18.5 Health. Some Games contain flashing lights or patterns that may trigger seizures in people with photosensitive epilepsy. If you or a minor you supervise have a history of epilepsy or experience symptoms such as dizziness, altered vision, eye or muscle twitching or loss of awareness while playing, stop immediately and consult a doctor. Take regular breaks.
19. Limitation of liability
19.1 Liability we do not limit. Nothing in these Terms excludes or limits our liability: (a) for death or personal injury caused by our negligence; (b) for fraud or fraudulent misrepresentation; (c) for damage caused intentionally or by gross negligence (including under Article 115 of the Turkish Code of Obligations No. 6098); (d) under any mandatory product liability law; or (e) to the extent such exclusion or limitation is not permitted under applicable law, including Mandatory Consumer Law.
19.2 If you are a Consumer in the EU, EEA, UK or Türkiye. Subject to clause 19.1, if you are a Consumer habitually resident in the EU, the EEA, the United Kingdom or Türkiye: (a) we are liable in accordance with the statutory provisions for damage caused by us, our legal representatives or our vicarious agents intentionally or through gross negligence; (b) in cases of slight negligence, we are liable only for the breach of an essential contractual obligation, meaning an obligation whose fulfilment is essential for the proper performance of these Terms and on whose fulfilment you may regularly rely, and our liability is limited to the damage that was foreseeable and typical for this type of contract at the time these Terms were concluded; (c) we are not responsible for loss or damage that was not foreseeable; and (d) nothing in this clause limits your statutory rights in respect of lack of conformity of the Service.
19.3 All other users. Subject to clause 19.1, if clause 19.2 does not apply to you: (a) Benerits will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data (including Cloud Saves and scores) or In-Game Rewards, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable; and (b) Benerits' total aggregate liability arising out of or in connection with these Terms or the Service will not exceed USD 100 (one hundred United States dollars) or its equivalent in local currency.
19.4 Loss of data. Subject to clauses 19.1 and 19.2, and considering that the Service is provided free of charge, you acknowledge that Cloud Saves are provided as a convenience (clause 10) and that you are responsible for any backups you wish to keep of progress stored locally in your browser.
20. Indemnity
20.1 If you use the Service otherwise than as a Consumer, you agree to indemnify and hold harmless Benerits, its affiliates and their officers, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your violation of any law or third-party right.
20.2 If you are a Consumer, clause 20.1 does not apply to you, and you are liable to us only in accordance with applicable law for loss caused by your culpable breach of these Terms.
21. Changes to the Service and to these Terms
21.1 Changes to the Service. We continuously develop the Service and may add, change or remove features, Games, or technical requirements. Where a change is material and negatively affects your access to or use of the Service, and you are a Consumer to whom Directive (EU) 2019/770 or equivalent Mandatory Consumer Law applies, we will make the change only for a valid reason (such as adapting to new technology, security needs, changes in law, changes in the availability of Games from Publishers, or improving the Service), at no additional cost to you, and with reasonable advance notice informing you of the change and of your right to terminate the contract free of charge within 30 days of the notice or of the change taking effect, whichever is later.
21.2 Changes to these Terms. We may amend these Terms to reflect changes in law or regulatory guidance, changes to the Service, new features, security or anti-fraud needs, or to clarify them. We will give you at least 30 days' notice of any material change by email (if you have an Account) and by a prominent notice on the Service before the change takes effect, together with a summary of the changes. Non-material changes (for example, correcting typographical errors or updating contact details) may take effect upon publication.
21.3 Your options. If you do not agree with a change, you may delete your Account before it takes effect, at no cost. If you continue to use the Service after the effective date, the amended Terms apply to you from that date. Where the law requires your express acceptance of a change, we will ask for it, and if you do not accept it we may terminate your Account in accordance with clause 15.3. Changes never apply retroactively to disputes that arose before they took effect.
21.4 Versions. Each version of these Terms is identified by a version number and effective date. Previous versions are available on request.
22. Governing law and disputes
22.1 Governing law. These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.
22.2 Consumer protections preserved. If you are a Consumer, the choice of law in clause 22.1 does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence (including under Article 6(2) of Regulation (EC) No 593/2008 (Rome I), where applicable).
22.3 Contact us first. Before starting formal proceedings, please contact us at [CONTACT EMAIL: [email protected]] so that we can try to resolve the matter informally. This does not affect any mandatory time limits or your right to go directly to a competent authority.
22.4 Consumers in Türkiye. If you are a Consumer resident in Türkiye: (a) for disputes whose value is below the monetary threshold determined annually by the Ministry of Trade under Article 68 of Law No. 6502 on Consumer Protection ([2026 THRESHOLD: TRY ___] for applications made in 2026), you must apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) at your place of residence or at the place where the consumer transaction was made; (b) for disputes above that threshold, you may bring proceedings before the Consumer Courts (Tüketici Mahkemeleri) at your place of residence or at the place where the consumer transaction was made, after completing the mandatory mediation process (arabuluculuk) required by Article 73/A of Law No. 6502, where applicable.
22.5 Consumers in the EU, EEA and UK. If you are a Consumer habitually resident in the EU or EEA, you may bring proceedings against us in the courts of the Member State where you are domiciled or in the courts of Türkiye, and we may bring proceedings against you only in the courts of the Member State where you are domiciled. If you are a Consumer resident in the United Kingdom, you may bring proceedings in the courts of the part of the United Kingdom in which you live. We are neither obliged nor, save where required by law, willing to participate in dispute resolution proceedings before a consumer arbitration board.
22.6 Other Players. If you are not a Consumer, or if clauses 22.4 and 22.5 do not apply, the courts and enforcement offices of Istanbul (Çağlayan) Central have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without prejudice to any mandatory rule of jurisdiction.
23. General
23.1 Entire agreement. These Terms (together with the documents incorporated in clause 1.3) are the entire agreement between you and Benerits regarding the Service as a Player and supersede any prior agreements on that subject.
23.2 Severability. If any provision of these Terms is held invalid, unfair or unenforceable, it will be modified to the minimum extent necessary to make it valid and enforceable (or, where that is not permitted, severed), and the remaining provisions remain in full force. If you are a Consumer, an invalid or unfair term is not binding on you and the remaining Terms continue to apply to the extent permitted by Mandatory Consumer Law.
23.3 No waiver. Our failure or delay in exercising a right does not waive it.
23.4 Assignment. You may not assign or transfer your rights or obligations under these Terms. We may assign or transfer our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, reorganisation or sale of all or part of our business, provided that, if you are a Consumer, your rights are not reduced as a result. We will notify you of any such transfer affecting you, and you may delete your Account if you do not agree.
23.5 Force majeure. We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, acts of government, failures of public networks or power supplies, cyber-attacks we could not reasonably have prevented, and failures of third-party hosting or advertising providers.
23.6 Third-party rights. Except as expressly stated, no third party has any right to enforce these Terms. Publishers may rely on clauses 6, 8 and 16 in respect of their Games.
23.7 Evidence. For the purposes of Article 193 of the Turkish Code of Civil Procedure No. 6100, and to the extent permitted by Mandatory Consumer Law, our electronic records (including acceptance records, logs and database entries) constitute evidence, without prejudice to your right to prove the contrary.
23.8 Notices. We may send you notices by email to the address associated with your Account or through the Service. You may send notices to us at [CONTACT EMAIL: [email protected]] or by post to [REGISTERED ADDRESS].
23.9 Language. These Terms are made available in English and Turkish. The two versions are intended to be substantively identical. In case of any conflict or inconsistency between them: if you are a Consumer resident in Türkiye, the Turkish version prevails; for Publishers and Creators, the English version prevails; in all other cases, the English version prevails, except where Mandatory Consumer Law requires otherwise.
