3.2 This Addendum, together with the documents incorporated in it, forms a separate contract for the Game within the meaning of Clause 2.3 of the Agreement.
3.3 In the event of conflict, Clause 2.2 of the Agreement applies. The Special Terms in Clause 7 override the Agreement only where they expressly state which provision of the Agreement they override.

4.1 The licences granted by the Publisher in Clause 4 of the Agreement apply to the Game from the Effective Date. Distribution through Native Wrappers is included unless it is excluded in the Special Terms (Clause 4.2 of the Agreement).
4.2 The Publisher authorises Benerits to release the Game on the Portal in Basic Launch on or after the Effective Date. Moving the Game to Full Launch is within Benerits' discretion under Clause 5.7 of the Agreement, and Benerits will record the date of Full Launch in the Studio.

If the figure shown in Clause 5.1 differs from the tier that applies under Schedule A to the exclusivity election made, the Revenue Share Percentage under Schedule A prevails, unless the Special Terms expressly provide for a different percentage.
5.3 The Revenue Share Percentage may change during the term of this Addendum only in accordance with Clause 9 of the Agreement or Clause 30.3 of the Agreement.
6. Exclusivity
6.1 If the exclusivity election is "Yes": the Publisher undertakes to comply with Clause 9 of the Agreement for the Game. The Publisher confirms that, as at the Effective Date, the web version of the Game is not available on any Other Web Portal, except as listed in the Special Terms with a removal date in accordance with Clause 9.5 of the Agreement.
6.2 If the exclusivity election is "No": no exclusivity commitment applies, and the Publisher may distribute the Game on other platforms, including Other Web Portals, without affecting the Standard Tier.
6.3 The Publisher may change its election from "No" to "Yes" only by accepting a new Addendum for the Game in the Studio, which will take effect from the first day of the following calendar month.
7. Special Terms
7.1 The following Special Terms apply to the Game:
